Đồng kính gửi: Các Hội đồng quản trị thành phố, quận hạt, văn phòng cảnh sát trưởng địa phương, các cơ quan thực thi pháp luật.

Về việc lợi dụng quyền tự do ngôn luận để xúc phạm cộng đồng người Việt tỵ nạn cộng sản tại hải ngoại.

Chúng tôi, những người ký tên dưới đây đại diện cho tập thể người Mỹ gốc Việt tỵ nạn cộng sản trong nhiều thập niên qua. Những người đã và đang sinh sống, làm việc, đóng góp hợp pháp cho xã hội Hoa Kỳ, với tinh thần yêu chuộng tự do, dân chủ và tôn trọng các giá trị nhân quyền. Xin trân trọng gửi đến Quý vị thư kiến nghị này.

Diễn biến sự việc:

Vào buổi sáng ngày 18 tháng 10 năm 2025 tại khu vực gần giao lộ đường Edinger và Brookhust, thuộc thành phố Westminster, tiểu bang California. Ông Nguyễn Solomon (quốc tịch Hoa Kỳ) tên Việt nam đầy đủ là Nguyễn Ngọc Lập (sinh năm 1951 tại Việt Nam). Ông Nguyễn Ngọc Lập đã luôn giới thiệu cá nhân là một nhân sĩ của cộng đồng người Việt, một nhà trí thức, người rất thông minh, rất am tường về lịch sử và chính trị. Đã công khai xử dụng quyền tự do ngôn luận, một quyền căn bản được Hiến pháp Hoa Kỳ bảo vệ, dùng những ngôn từ khiếm nhã, thô tục mang đầy tính miệt thị, nhằm xúc phạm nghiêm trọng và bôi nhọ trực tiếp đến:

Đây không phải là lần đầu tiên mà đã rất nhiều lần trước đây, ông Nguyễn Ngọc Lập được sự trợ giúp của ông Vũ Huy Linh người trực tiếp điều hành kênh Youtube “360USA” đã có những phát ngôn không chỉ xâm phạm nghiêm trọng đến danh dự, nhân phẩm của các tập thể nêu trên, mà còn gây tổn thương sâu sắc về tinh thần cho những cá nhân, những gia đình đã từng trải qua với nhiều khổ đau, mất mát trong cuộc chiến đấu chống lại sự xâm lăng của cộng sản bắc việt, để bảo vệ chính nghĩa cho nền tự do dân chủ. Những nội dung phát biểu của ông Nguyễn Ngọc Lập đang được phát tán rộng rãi trên mạng xã hội thông qua kênh “360USA” đã làm gia tăng mức độ tiêu cực và tác động lan truyền của sự xúc phạm nói trên.

Thưa Quý vị,

Chúng tôi hiểu rằng quyền tự do ngôn luận là nền tảng xây dựng nên xã hội dân chủ Hoa Kỳ kể từ ngày lập quốc và đã được hiến pháp bảo vệ trong suốt hơn 250 năm qua. Tuy nhiên, việc ông Nguyễn Ngọc Lập được hỗ trợ bởi ông Brian Vũ Huy Linh người chủ xướng kênh Youtube "360USA", lợi dụng quyền hiến định (Tu chính án số 1) này để tấn công đến nhân phẩn, danh dự, của những nạn nhân chiến tranh, khơi lại hận thù mà vết thương cần phải được hàn gắn, hoặc cố tình gây ảnh hưởng tiêu cực, kể cả sự kỳ thị chủng tộc... đến tinh thần và sự đoàn kết cộng đồng. Kích động xung đột có nguy cơ gây bạo loạn trật tự công cộng. Tạo môi trường thù nghịch có thể là nguyên nhân dẫn đến những hậu quả khó lường trong cộng đồng người Việt tỵ nạn.

“xin dẫn chứng lại sự việc của Trần Trường, cơ sở Hi-Tek đã treo ảnh Hồ Chí Minh và cờ đỏ sao vàng năm 1999 tại khu phố Bolsa, thành phố Westminster. Đã khơi dậy một làn sóng phẫn nộ, biểu tình phản đối trong suốt 53 ngày đêm, nơi cộng đồng người Việt coi là thủ đô tinh thần của người tỵ nạn. Nơi mà lá cờ với nền vàng có 3 sọc đỏ (VNCH) đã được 144 hội đồng thành phố khắp nước Mỹ, 33 chính quyền cấp tiểu bang Hoa Kỳ, chính phủ Úc Đại Lợi, và Canada vinh danh, công nhận là một di sản văn hóa của cộng đồng người tỵ nạn phải được duy trì và bảo vệ”.

Với tinh thần thượng tôn luật pháp, và các giá trị của nền dân chủ, tự do Hoa Kỳ, và mong muốn được đóng góp vào một xã hội tôn trọng công bằng, an bình, và văn minh. Chúng tôi xin đề nghị đến chính phủ cùng các cơ quan hữu trách có thẩm quyền:

Chúng tôi xin nhấn mạnh là không cáo buộc phạm tội bất cứ cá nhân nào. Tuy nhiên vì trách nhiệm và nghĩa vụ của công dân yêu tổ quốc và được bảo vệ bởi Hiến pháp Hoa Kỳ Tu Chính Án số một. Xin đệ trình kiến nghị này để quý cơ quan hữu trách điều tra, thẩm định, phân xử. Chúng tôi cam kết cung cấp đầy đủ bằng chứng khi được Quý cơ quan yêu cầu.

Một lần nữa, xin chân thành gửi đến quý vị lời cảm ơn và rất mong được quý cơ quan xem xét hồi đáp vụ việc nêu trên.

cc: The Department of Justice, Department of State, Department of Homeland Security, and all agencies responsible for safeguarding freedom, community security, and public order. The City Councils, County Boards of Supervisors, Offices of the Sheriff, City Chief of Police, and local law-enforcement agencies.

Subject: Request for review and investigation regarding the misuse of the freedom of speech to defame and offend the overseas Vietnamese anti-communist refugee community, and for examination of potential violations of federal and state law.

Honorable Officers,

We respectfully submit this letter to request your review and investigation into matters that may affect the safety, dignity, and the lawful rights of members of the overseas Vietnamese anti-communist refugee community. Concerns have arisen regarding conduct that may involve misuse of protected speech in a manner that targets, defames, or harms a vulnerable community. Additionally certain actions may potentially fall within the scope of existing federal and state statutes governing fraud, false statements, public safety, and misuse of public benefits.

We therefore respectfully request that the relevant agencies consider reviewing the following areas for potential violations:

Preamble

As the Vietnamese American community across the United States continues to grow and contribute meaningfully to the social and civic fabric of the United States, we are deeply concerned about recent developments that threaten community harmony, safety, and stability. In spirit of civic responsibility and respect for the rule of law, we respectfully submit this petition to federal authorities, requesting a review of activities that may disrupt public order or negatively impact on our community.

1/ Petition Statement

In the morning of October 18, 2025, in the City of Westminster, County of Orange, State of California, near the intersection of Edinger Street and Brookhurst Street. This is not the first occurrence; it has happened repeatedly in the past and has come to our attention that Mr. Solomon Nguyen, a US citizen, born 1951 (aka) Nguyen Ngoc Lap. (Furthermore, Mr. Solomon Nguyen has consistently presented himself as prominent figure within the Vietnamese community, portraying himself as an intellectual, highly intelligent, and deeply knowledgeable about history and politics), with the Assistance and encouragement of individuals such as:

Mr. Linh Huy Vu, who manages the YouTube channel 360USA, and Mr. Lan Hoang Vu from the YouTube channel PhoBolsaTV. Has improperly exploited the protections of the First Amendment to misuse of First Amendment right to defame and harm war victims and threaten community unity.

We recognize that freedom of speech is a foundational principle of American democracy. However, freedom of speech is not a shield for harmful conduct, nor permission to defame or attack the dignity of others.

It has come to attention that Mr. Solomon Nguyen, with support from the operators of the YouTube channels 360USA and PhoBolsaTV, misused the First Amendment to:

These developments have raised serious concerns, as they may directly affect public safety, community security, and social order. engaging in actions that create division, incite conflict, harass, and insulted community members, or otherwise participate in propaganda for the Communist of Vietnam that could potentially violate U.S. Law.

Such conduct goes far beyond legitimate commentary and constitutes defamation, harassment, and intentional infliction of emotional distress. These behaviors reopen old wounds and reignite hostilities that should instead healed, while intentionally creating negative impacts including radical discrimination on the mental well-being and unity of the community. This incites conflict and poses a risk of disorder and public unrest. By fostering a hostile environment, it may lead to unpredictable and profound consequences within the Vietnamese refugee community.

“We also cite the historical Trần Trường / Hi-Tek Video incident in Westminster’s Little Saigon, where the display of a portrait of Hồ Chí Minh and the red flag with a yellow star in November 1999 triggered continuous peaceful protests lasting 53 days and nights. The yellow flag with three red stripes (former Republic of Vietnam) has been honored and recognized as a cultural heritage symbol of the Vietnamese refugee community by 144 city councils across the United States, 33 U.S. state governments, and the governments of Australia and Canada. This symbol represents the identity, history, and collective memory that the community is committed to preserving and protecting”

We emphasize that we are not making accusations of guilt, but we reserve the right to pursue all legal remedies under federal and state law.
